Introduction

Buying your first home in Noida is an exciting milestone, but navigating the legal landscape requires careful attention. Since the implementation of the Real Estate Regulatory Authority (RERA), the market has become significantly safer for buyers — but thorough due diligence is still essential.

Step 1: Verify RERA Registration

Always verify the project's RERA registration number on the UP RERA portal:

  1. Visit up-rera.in
  2. Search by developer name or project name
  3. Confirm registration status is "Active"
  4. Review declared completion timeline and carpet area disclosures
⚠️ Never purchase in a project that claims RERA approval without an active registration number.

Step 2: Review the Builder-Buyer Agreement (BBA)

Check the Allotment Letter and BBA carefully for:

  • Hidden charges: Maintenance deposits, parking levies, club membership
  • Penalty clauses: Are they one-sided? RERA mandates mutual penalty provisions
  • Super built-up vs carpet area: Demand a clear carpet area declaration
  • Force majeure clauses: What circumstances excuse builder delays?

Step 3: Title & Encumbrance Search

Before registration, conduct a title search at the Noida Sub-Registrar Office:

  • Verify no encumbrance or mortgage on the plot/flat
  • Confirm the builder has a clear land title from the Noida Authority
  • Check for any pending litigation (High Court and NCLT records)

Step 5: Get a No Dues Certificate

Before possession, obtain:

  • No Dues Certificate from the Noida Authority
  • Occupancy Certificate (OC) from Noida Authority
  • Completion Certificate (CC) — mandatory for legal occupancy
